ISLAMABAD, Mar 01,2022- Islamabad High Court on Tuesday, declared marriage under 18 illegal.

Islamabad High Court upheld age-related decision on marriage petition of 16-year-old girl.

Justice Babar Sattar wrote in his judgment that a girl under 18 cannot marry freely till biologically she is 18 years old.

The court ruled that mere physical changes do not constitute legal puberty before the age of 18, the legal age of adulthood is 18 years, therefore the marriage of a minor girl will be illegal.

 The verdict stated that the parents of a girl under the age of 18 could not entered into any contract which is physical contact.

The court ruled on the request of Mumtaz Bibi filed for her daughter’s recovery and ordered 16-year-old Swaira Falk Sher to be returned to her mother.

The court also ordered SHO Golda to return the girl from Darul Aman to her mother.

The court directed the Cabinet Division to table the matter before the Parliament regarding explanation in the Muslim Family Law Ordinance.

 Mumtaz Bibi filed a case for abduction of the daughter from May 2021 after the girl filed a will in the High Court.
